These terms are an agreement between you and Rida F’kih, an individual in Alberta, Canada, who makes and runs Voke (“Voke”, “we”, “us”). They cover the Voke iPhone app, the website at voke.co and the services behind them, including Voke’s connection for AI apps.
By creating an account or using Voke, you agree to these terms. If you don’t agree, don’t create an account or use Voke. Please read the privacy policy too: it says what data Voke collects, where it goes and how long it’s kept.
1. What Voke is
Voke shows you health data from the sources you connect: Apple Health and Google Health. It lets you share chosen categories of that data with people you invite to a circle, ask questions about it with Ask Voke, get a morning summary, and connect AI apps that can read it.
2. Voke isn’t medical advice or a monitoring service
Voke is for general wellness and fitness tracking. It isn’t a medical device, and nothing in it is medical advice, diagnosis or treatment. Scores, summaries, heart events and AI answers are estimates from consumer devices and software. They can be wrong or incomplete, and AI answers in particular can be mistaken.
Heart events mark times when your heart rate stayed over 120 or under 40 beats per minute for at least 10 minutes while you seemed inactive. They aren’t arrhythmia detection or a medical alert, and Voke doesn’t tell anyone when one happens.
Sharing in a circle isn’t a monitoring or safety service. Voke doesn’t alert anyone about your health, and nobody should rely on it to watch over another person.
Don’t use Voke to diagnose or treat any condition, or to decide whether to get care. Talk to a doctor or other qualified health professional about your health. In an emergency, call your local emergency number. See the health disclaimer for more.
3. Who can use Voke
- You must be at least 18 years old and able to make a binding agreement where you live. Don’t invite anyone under 18 to a circle.
- During the beta, Voke is offered only to people who live in Canada outside Quebec, or in the United States. It isn’t offered yet in Quebec, the European Union, the European Economic Area or the United Kingdom. If you live in one of those places, please don’t sign up yet.
4. The beta
- Voke is in beta. Features may change, break or be removed, and we may limit or end the beta at any time (see section 13 for what happens if Voke shuts down).
- Beta builds are distributed through Apple’s TestFlight, under Apple’s TestFlight terms. Beta builds are free and will never be charged for.
- We back up your data, but a beta can have bugs. Your sources (Apple Health and Google) keep their own copies of your data, so please don’t treat Voke as the only copy.
5. Your account
- You sign in with Apple. Keep your Apple account and your iPhone secure.
- You’re responsible for what happens on your account and the devices you sign in on. If you lose a device, use “Sign out of all other devices” in your account settings.
- Only connect health data that’s yours.
6. Your data
- Your health data is yours. You give Voke permission to store, process and display it only to provide the service as described in the privacy policy: to show it to you, to the people you choose to share with, and to the AI features and AI apps you choose to use.
- Voke doesn’t sell your health data and doesn’t use it for advertising.
- Data from Google is used only for the features you see in Voke, under Google’s Limited Use requirements. It’s never used for advertising, never sold and never used to train AI models. See how Voke uses your Google data.
- Apple Health data is used only to provide Voke’s health features to you and the people you share with. It’s never used for advertising or marketing and never sold.
- If you live in a US state with a consumer health data law, such as Washington, see our consumer health data notice.
- You can delete your account and your data at any time (see section 13).
7. Sharing with other people
- You decide what you share and with whom. Only invite people you trust, and only share what you’re comfortable with them seeing.
- Data others share with you is theirs. Use it only to view it in Voke. Don’t copy, publish or pass it on without their permission, and don’t use it against them.
- When someone shares less with you or stops sharing, you lose access to what they took back.
- When someone shares less with you, stops sharing, leaves your circle, or stops letting your AI read their data, Voke deletes your Ask Voke messages that used it. This runs in the background shortly afterwards, not instantly.
8. AI features
Ask Voke and the morning summary
- Ask Voke and the morning summary send some of your health data to an AI model provider, as described below. You can turn AI features off at any time (see “Turning AI off”).
- When you use Ask Voke, or when Voke writes your morning summary, your question, earlier messages in that conversation and the health data needed to answer are sent through Vercel’s AI Gateway to an AI model provider in the United States. Requests are sent with zero data retention: the provider must not keep the data or use it for training. The privacy policy has the details.
- Ask Voke answers and morning summaries are written by an AI model. They can be wrong. Check anything important with a professional.
AI apps you connect
- You can connect an AI app that supports the Model Context Protocol (MCP), such as Claude or ChatGPT. You approve each connection on your phone and choose which categories it can read. The connection is read-only.
- When you connect an AI app, you’re directing Voke to send it the data you chose, including data that came from Google or Apple Health. The app is run by another company, and its own terms, privacy policy and data retention apply, not ours. Voke’s zero data retention setting doesn’t apply to it. Voke isn’t responsible for what those apps do with data you let them read, or for their answers.
- Other people’s AI can only read your data if you turn on “Let their AI see this too” in a circle you share with them. It’s off unless you turn it on.
Turning AI off
You can turn AI off with one switch, “Use AI features”, in your account settings. Turning it off:
- disconnects every AI app you connected;
- stops Ask Voke and the morning summary;
- permanently deletes your Ask Voke chats and morning summaries;
- deletes other people’s Ask Voke messages that used your data; and
- keeps your data out of everyone else’s AI, including Ask Voke for people in your circles.
If you turn AI back on later, deleted chats don’t come back and you’ll need to connect your AI apps again.
9. Acceptable use
Don’t:
- try to read data that wasn’t shared with you, or get around Voke’s sharing settings;
- interfere with or overload the service, probe it for weaknesses without our permission, or reverse engineer it except where the law allows;
- use Voke to harass, stalk, monitor or control anyone, including through a circle;
- invite or share someone else’s data without their permission;
- use automated tools to access Voke, other than AI apps connected through Voke’s own connection flow;
- use Voke in breach of any law.
If you find a security problem, please tell us at [email protected]. See how Voke protects your data.
10. Sources and other services
Voke depends on Apple, Google, Vercel, AI model providers and the AI apps you connect. They may change or stop their services, limit what Voke can read, or ask you to approve access again. Voke isn’t responsible for their services, and their terms apply to your use of them.
11. Apple
If you got Voke from the App Store, Apple’s standard licensed application end user license agreement applies to your use of the app. These terms add to it. If the two conflict about the app, Apple’s agreement wins.
These terms are between you and us, not Apple. Apple isn’t responsible for Voke or its content, and has no duty to maintain or support it. Questions, complaints and claims about Voke, including product liability, legal compliance and intellectual property claims, come to us, not Apple. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
12. Price
Voke is free during the beta. If we introduce paid plans, we’ll tell you the price before you’re charged, and you’ll only pay if you choose to. Any subscription will be sold and managed through the App Store.
13. Ending your use
- You can stop using Voke and delete your account at any time from the Account screen in the app, or see how to delete your account. The privacy policy says what deletion removes and when.
- We may suspend or close your account if you break these terms, if the law requires it, or to protect other people or the service. Where we can, we’ll tell you first and let you delete your account yourself.
- If we shut Voke down, we’ll give you at least 30 days’ notice in the app and by email if we have your address, and then delete all accounts and data.
14. Our content
Voke’s app, website, design and code belong to Rida F’kih. We give you a personal, non-transferable licence to use them only as these terms allow.
15. Feedback
If you send us ideas or feedback, we may use them without owing you anything.
16. Disclaimers
Voke is provided “as is” and “as available”. To the extent the law allows, we make no promises that Voke will be accurate, available without interruption, or free of errors, or that it will suit any particular purpose.
17. Limit of liability
To the extent the law allows, Voke isn’t liable for indirect, incidental, special or consequential losses, or for lost profits or revenue. Our total liability for any claim about Voke is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $100.
This doesn’t limit liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit.
18. Rights these terms don’t take away
- Nothing in these terms limits our duties under privacy and data breach law, including our duty to protect your data and to tell you about a breach. Sections 16 and 17 don’t apply to those duties.
- Nothing in these terms limits rights you have under consumer protection law where you live that can’t be waived. If a part of sections 16 to 18 isn’t allowed where you live, it doesn’t apply to you.
19. Indemnity
If you break these terms or the law while using Voke, and that leads to a claim against us, you agree to cover our reasonable losses from it, to the extent the law allows.
20. Changes to these terms
- We may change these terms to reflect changes to Voke, to the law or to how we run the service. We’ll update the date at the top.
- For any change that affects your rights, we’ll tell you in the app and by email if we have your address at least 30 days before it takes effect, and show you what’s changing. If you don’t agree, you can delete your account at no cost before then. If you keep using Voke after the change takes effect, the new terms apply.
- We won’t start using or sharing your health data in a new way without asking for your permission first. A change to these terms is never that permission.
21. Law and disputes
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Disputes go to the courts of Alberta. If you’re a consumer, you keep any right the law where you live gives you to bring a claim in your local courts, and any protections of your local law that can’t be waived. These terms don’t require arbitration and don’t waive your right to join a class action.
22. General
- If part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a term straight away, we haven’t given up the right to.
- You can’t transfer these terms to someone else. We can transfer them as part of a sale, merger or move of Voke to a company, with at least 30 days’ notice to you. Your data stays covered by the privacy policy after a transfer, the new owner can’t use your health data for any other purpose, and you can delete your account before the transfer happens.
- These terms, the privacy policy, the health disclaimer, how Voke uses your Google data, the consumer health data notice and, for App Store copies, Apple’s licensed application end user license agreement are the whole agreement between you and us about Voke.
